The company name is the name under which the merchant carries on business and under which the company is entered in the commercial register. Company naming laws have been significantly liberalised. They now allow personal names, descriptive names and even fanciful names. It does, however, require that the company name be distinctive, identifiable and not misleading.
Your notary will advise you on which names are permitted. In cases of doubt, we will clear your chosen company name with the chamber of commerce and court of registration in advance.
Every company name must have a suffix indicating the legal structure. This is generally done by common abbreviations such as GmbH (limited liability company), AG (public limited company), e.K. (registered merchant), KG (limited partnership) and UG (entrepreneurial company).
